Crime scene cleaning company sues to recover $30K

An Illinois clean-up corporation, alleges the owners of a Nederland home refuse to pay it more than $30,000 for work it performed following a man’s death.

Aftermath Inc. filed a lawsuit July 28 in Jefferson County District Court against the estate of Kenneth J. Fletcher and Bobby Fletcher. According to its website, Aftermath Inc. specializes in crime scene and trauma clean up.

In its complaint, Aftermath alleges it was contacted following Kenneth J. Fletcher’s death to clean the home at 1415 18th St. in Nederland where he died at some point prior to March 28, 2010.

“The circumstances of his death resulted in a biohazardous situation in the Residence requiring Plaintiff’s specialized services,” the suit states.

On March 28, Aftermath and Bobby Fletcher entered into an agreement in which Bobby Fletcher agreed to pay the company to clean the home, the complaint says.

Following the three days of cleaning, Aftermath claims it billed Bobby Fletcher $33,722.31. However, it still has not received any payment for its services, according to the complaint.

Aftermath alleges breach of contract against the defendants.

In addition to the money it says Bobby Fletcher owes it, Aftermath seeks pre-judgment interest at the highest rate, attorneys’ fees, post-judgment interest, an order that that the Nederland house be sold and proceeds applied to the money due to Aftermath and other relief the court deems just.

Michael G. Oddo of Henry, Oddo, Austin and Fletcher in Dallas will be representing it.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.

    Aftermath team came out to house exceptional fast. like a 911 call. looked at house and took pictures. then i asked for an estimate. many times and was refused. i asked at worse case scenario what is the max this job could cost. refused to answer. i then asked if this job would be over ten thousand. he refused to answer. after asking the question in different words just for a estimate at a wide rang on the whole company. the team leader said to me that the company average jobs range from 10k-150k . the team was very nice and friendly and understanding of our loss while on the site even when refusing to give me a price number. The team leader told us not to worry cause homeowners insurance would cover the cost as long as its not personal property and helped me sign a 10+ page contract. After the team completed the job we looked at what they did. and the cut out 4×4 hole a bed mattress and box spring. and a 5×5 in the carpet under the mattress and box. then washed the walls. paper work stated it took 44 hours to do the entire job. few weeks later i get an invoice with a bill over $32,000 and a lien on my house.
